Part 1 – Introduction, History, Objectives, Features & Criminal Justice System

1. Introduction

The Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 is India's new procedural criminal law that replaced the Code of Criminal Procedure (CrPC), 1973.

It lays down the procedure for:

Registration of criminal cases

Investigation by police
Arrest of accused persons
Bail
Search and seizure
Trial before criminal courts
Appeal and revision
Execution of sentences
Protection of victims and witnesses
In simple words:
BNS defines offences, BNSS explains how criminal cases proceed, and the Bharatiya Sakshya Adhiniyam (BSA) lays down the rules of evidence.

2. Historical Background
Before Independence
India followed English criminal laws.
The Criminal Procedure Code was enacted in:
1861
1872
1882
1898
The CrPC, 1898 remained applicable until replaced.

After Independence
In 1973, Parliament enacted the Code of Criminal Procedure, 1973 (CrPC).
It came into force on 1 April 1974.
For nearly five decades, CrPC governed criminal procedure.

Why Replace CrPC?
CrPC was enacted nearly fifty years ago.
During this period:
Technology changed.
Digital evidence emerged.
Cybercrime increased.
Online fraud became common.
Video conferencing became widespread.
Electronic records gained importance.
Investigation methods modernized.
Victim rights received greater emphasis.
To address these changes, Parliament enacted the BNSS in 2023.

3. Need for BNSS
The major reasons were:
A. Modern Criminal Justice
The earlier law lacked provisions for:
e-FIR
Digital records
Electronic summons
Forensic investigation
Audio-video recording
Online proceedings
BNSS introduces procedures for modern technology.

B. Faster Justice
Cases often remained pending for years.
BNSS introduces timelines for:
Investigation
Filing charge sheets
Pronouncement of judgments
Appeals in certain situations
The aim is to reduce delays.

C. Victim-Centric Justice
Earlier, criminal procedure focused more on the accused.
BNSS strengthens:
Victim participation
Information to victims
Witness protection
Timely investigation

D. Scientific Investigation
The law emphasizes:
DNA analysis
Fingerprints
Forensic science
Digital evidence
Electronic records

4. Objectives of BNSS
The primary objectives are:
Speedy justice
Transparent investigation
Use of technology
Scientific evidence
Victim protection
Efficient policing
Reduction in pendency
Fair trial
Accountability
Better coordination among agencies

5. Important Features of BNSS
1. Electronic FIR (e-FIR)
A person may provide information electronically in specified cases, subject to procedural requirements.
Example: A cyber fraud victim can initiate reporting electronically instead of immediately visiting a police station.

2. Zero FIR
A police station may register an FIR even if the offence occurred outside its territorial jurisdiction and then transfer it to the appropriate police station.
Example: A crime committed in Jammu can be reported initially at a police station in Srinagar if immediate reporting is necessary.

3. Digital Investigation
BNSS recognizes:
Digital documents
Electronic communication
Audio-video recording where applicable
Modern investigative methods

4. Forensic Investigation
For serious offences, forensic examination is given greater importance to improve the quality of investigation.

5. Video Conferencing
Certain proceedings can be conducted through video conferencing as permitted by law and the court.

6. Faster Investigation
Timelines are introduced in several stages of investigation and trial to reduce unnecessary delay.

7. Protection of Victims
Victims are entitled to receive information about the progress of their case in situations provided by law.

8. Witness Protection
BNSS supports measures to safeguard witnesses and encourage truthful testimony.

9. Electronic Summons
Summons may be served using electronic means where legally permissible.

10. Transparency
The law encourages greater use of digital records and documentation, reducing opportunities for manipulation.
