FRANCHISE AND UNIVERSAL ADULT FRANCHISE

Introduction

India is the largest democracy in the world, where the people are the ultimate source of political power. The success of a democratic system depends on the active participation of its citizens in elections. This participation is made possible through the right to vote, known as Franchise or Suffrage.

The Constitution of India adopted Universal Adult Franchise from the very beginning, ensuring that every eligible adult citizen has an equal right to vote without discrimination based on religion, caste, sex, race, wealth, education, or social status. This decision reflected the commitment of the Constitution makers to political equality, social justice, and democracy.

Meaning of Franchise

The term Franchise refers to the legal right of a citizen to vote in elections and choose representatives to govern the country.

It is also known as Suffrage or Voting Rights.

Definition

Franchise is the constitutional and legal right of an eligible citizen to participate in elections by casting his or her vote.

Voting is one of the most important political rights in a democracy because it allows citizens to influence government policies and leadership.


Meaning of Universal Adult Franchise

Universal Adult Franchise means that every adult citizen of the country has the right to vote irrespective of religion, caste, gender, race, language, education, property, wealth, or social status, provided he or she fulfills the qualifications prescribed by law.

It is based on the democratic principle:

"One Person, One Vote, One Value."

This principle ensures political equality among all citizens.


Constitutional Provision

The Constitution of India provides for Universal Adult Franchise under:

Article 326

Article 326 states that elections to the Lok Sabha and the State Legislative Assemblies shall be held on the basis of Adult Suffrage.

The right to vote is available to every citizen who fulfills the qualifications prescribed by law.


Historical Background

During British rule, India did not have Universal Adult Franchise.

Only a small section of society was allowed to vote.

Voting rights were restricted on the basis of:

Property ownership

Income
Education
Payment of taxes
Social status

As a result, only a very small percentage of Indians could participate in elections.

After Independence, the Constituent Assembly decided to establish a truly democratic system by granting voting rights to all adult citizens.

India became one of the first developing countries to introduce Universal Adult Franchise from the very beginning of its constitutional journey on 26 January 1950.

This was a revolutionary step because a large percentage of the population was illiterate and economically weak, yet every adult citizen was trusted with equal voting rights.


Types of Franchise

1. Restricted Franchise (Limited Franchise)

Under this system, only selected people are allowed to vote.

Eligibility may depend upon:

Property

Income
Education
Religion
Gender
Payment of taxes

Characteristics

Voting rights are limited.

Political equality is absent.
Rich and educated people receive preference.
It is considered undemocratic.

2. Universal Adult Franchise

Under this system every eligible adult citizen can vote without discrimination.

Equal voting rights.

Democratic participation.
No discrimination.
Inclusive government.

India follows this system.


Qualifications for Voting in India

A person is eligible to vote if he or she:

Is a citizen of India.

Has completed 18 years of age.
Is registered in the electoral roll of the constituency.
Is not disqualified under any law.

Disqualifications for Voting

A person may be disqualified if:

Declared to be of unsound mind by a competent court.

Disqualified due to corrupt electoral practices.
Convicted for certain offences under election laws.
Disqualified under provisions of law made by Parliament.

Voting Age in India

Initially

The minimum voting age was 21 years.

Present

The minimum voting age is 18 years.

Constitutional Amendment

The 61st Constitutional Amendment Act, 1988 reduced the voting age from 21 years to 18 years to encourage greater participation of youth in democracy.

The Election Commission of India (ECI) is an independent constitutional body responsible for conducting free and fair elections.
