Amazon KDP Authors in India: Does the New RBI EDF Rule Apply to Your eBook Royalties?

The Reserve Bank of India’s new Foreign Exchange Management (Export and Import of Goods and Services) Regulations, 2026 have created questions among Indian freelancers, YouTubers, digital creators and online publishers.

One important question is:

If an Indian author publishes eBooks through Amazon Kindle Direct Publishing (KDP) and receives royalties from international Amazon marketplaces, does the author have to file an Export Declaration Form (EDF)?

The answer requires some caution.

What is the New RBI EDF Rule?

The new regulations come into force from 1 October 2026.

Under the regulations, an exporter of services has to furnish an Export Declaration Form (EDF) declaring the full export value of services. For service exports, the EDF is generally to be submitted within 30 days from the end of the month in which the invoice is raised. A single EDF can cover service exports to one or more recipients during a month. For services other than software, the EDF may also be submitted on or before receipt of payment. 

However, this does not automatically mean that every person receiving money from a foreign company must file an EDF.

The nature of the income and transaction is important.

What About Amazon KDP Authors?

An Indian author using Amazon KDP is generally not in the same position as a freelancer who sends an invoice to a foreign client for marketing, consulting or software-development services.

Through KDP, the author publishes an eBook and grants Amazon rights under the KDP agreement. Amazon calculates royalties based on eligible sales and pays the author according to its payment system.

Amazon's KDP payment documentation confirms that royalties can be generated from different Amazon marketplaces and that Indian authors can receive KDP payments through direct deposit in India. 

Therefore, you should not assume that every KDP royalty is automatically an “export of services” requiring an EDF.

There is currently an important distinction between:

Direct service export

and

Royalty/licensing income from publishing an eBook through a platform.

The applicable FEMA treatment can depend on the contractual structure and the nature of the particular payment.

Example: Indian Author Selling an eBook in the USA

Suppose an author living in India publishes:

“Indian History Made Easy”

through Amazon KDP.

The book is available on Amazon.com and customers in the USA purchase the eBook.

Amazon calculates the author's royalty and subsequently pays the author.

This transaction should not simply be described as:

“The author provided a service to an American customer, therefore the author must file EDF.”

The underlying transaction is more complicated because the author is earning a royalty through Amazon's publishing/distribution arrangement.

Therefore, the author should not independently file an EDF merely because the KDP dashboard shows sales in the USA.

What If Amazon or Its Payment Partner Asks for Documentation?

This is different.

If the bank receiving your KDP payment asks for:

Purpose of payment

Nature of income

Invoice

Agreement

Royalty statement

Payment statement

Foreign-exchange declaration

or other documentation,

you should provide the appropriate information and ask the bank how the transaction should be classified.

This is especially important after 1 October 2026, when the new FEMA framework becomes effective.

The Authorised Dealer bank has an important role in processing and monitoring foreign-exchange transactions. The regulations also provide that the bank must satisfy itself about the genuineness of the transaction when handling export receipts.

Do KDP Authors Need to Raise an Invoice Every Month?

Do not assume that you must create an artificial invoice simply to comply with the new EDF rule.

An EDF requirement applies to transactions falling within the applicable export framework. Whether your KDP royalty arrangement requires an EDF and what supporting documentation is appropriate should be determined from the actual KDP contractual arrangement and the bank's treatment of the payment.

An author should not create a false or inaccurate service invoice just because a payment arrived from overseas.

Keep Your KDP Records Safely

Indian KDP authors should maintain proper records of their international publishing income.

Important records include:

KDP Royalty Reports

KDP Payment Reports

Amazon marketplace sales information

Payment statements

Bank statements

Tax withholding details

KDP account and tax-profile information

Relevant Amazon/KDP contractual documentation

These records can help establish the source and nature of the payment if the bank or tax professional asks for clarification.

Amazon's payment report identifies information such as the sales period, accrued royalty, tax withholding, payment amount and the source of the royalty, such as eBook sales or KENP royalties. 

What About Foreign Tax Withholding?

This is another issue that should not be confused with EDF.

Amazon's KDP tax system can involve withholding tax depending on the marketplace and the author's tax status.

For example, Amazon states that non-US persons need to complete their KDP tax profile and that certain US-source KDP royalties can be subject to US withholding, depending on the applicable tax rules and treaty benefits.

Therefore, an Indian author's KDP income can involve two separate questions:

1. Foreign tax withholding

and

2. Indian FEMA/banking compliance

EDF is not the same thing as tax withholding.

What About Income Tax in India?

KDP royalty income can also have Indian income-tax implications.

The fact that Amazon has already deducted foreign tax, where applicable, does not automatically mean that there is no Indian tax obligation.

The author should maintain records of:

KDP income

Foreign tax deducted

Bank receipts

Exchange rates/conversion details

Expenses, where relevant

Other professional or business income

The final tax treatment depends on the author's individual circumstances and the applicable Indian tax provisions.

Does an Amazon KDP Author Need an IEC?

An author should also avoid assuming that an Import Export Code (IEC) is automatically required merely because the author receives KDP royalties from overseas.

IEC requirements and FEMA export-declaration requirements are separate questions.

The relevant question is first:

What exactly is the nature of the KDP transaction?

Then:

How does the Authorised Dealer bank classify and document that receipt?

What Should an Indian KDP Author Do After 1 October 2026?

The safest practical approach is:

1. Continue publishing normally

The new RBI regulations do not prohibit Indian authors from publishing books through Amazon KDP.

2. Maintain KDP statements

Download and preserve your monthly royalty and payment reports.

3. Keep bank records

Keep the bank credit entries corresponding to KDP payments.

4. Don't create unnecessary invoices

Do not manufacture a service invoice when there is no genuine service-invoice relationship.

5. Ask your AD bank about classification

If your bank asks about KDP receipts, explain clearly that the payment represents Amazon KDP publishing royalties and provide the relevant KDP statement.

6. Keep tax records separately

FEMA compliance, income tax and foreign tax withholding are separate matters.

Important Point for Small KDP Authors

Suppose an Indian author earns only:

from Amazon KDP.

The amount alone does not answer whether an EDF is applicable.

The nature of the transaction is the key issue.

The new regulations contain specific provisions for export declarations and also provide an important ₹10 lakh threshold for certain EDPMS closure procedures relating to shipping bills/invoices. That provision should not be misunderstood as saying that all exports below ₹10 lakh are automatically exempt from every FEMA requirement.

Final Conclusion

The new RBI EDF framework is important for Indian businesses, freelancers and service exporters, but Amazon KDP authors should not panic or assume that every international eBook royalty automatically requires an EDF.

KDP royalty income is not necessarily the same transaction as providing a conventional service to a foreign client.

The correct treatment depends on the legal and contractual nature of the KDP arrangement, the source and character of the payment, and the manner in which the Authorised Dealer bank handles the foreign-exchange receipt.

Therefore, if you are an Indian KDP author receiving royalties from Amazon.com, Amazon.co.uk, Amazon.de or other international marketplaces, the sensible approach is to keep complete KDP royalty/payment records and ask your AD bank for the appropriate FEMA classification if documentation is requested.

Most importantly: EDF is not a new tax on Amazon authors.
